Divorce in Georgia

The decision to file for divorce is, understandably, a difficult one. At The Falcone Law Firm, P.C. we try to make the process as painless as possible. We work with you to determine what is most important to you and to try and protect you from future disputes.

Except in cases where your spouse cannot be properly served or lives outside the state's jurisdiction, issues of child custody, child support, alimony, and property division will all be handled as part of the divorce process. If your spouse cannot be properly served or lives outside the state, a divorce can still be granted without resolving all of the other issues.

In order to file for divorce in the State of Georgia, you must have lived in the state for at least six (6) months. It does not matter where you where married. You can get even get a divorce if your spouse does not live in the state or refuses to participate in the process.

There are numerous "grounds" or legal reasons for divorce, but the most common is that the marriage is "irretrievably broken". This means that the parties have decided they are unable to get back together.

Divorces can be contested or uncontested. In an uncontested divorce, the parties are able to reach agreement on all issues without the need for any hearings or additional legal process. Contested divorces can be limited to one or two minor issues or can mean that there is no agreement between the parties.
